IP Edge entity, Savannah Licensing, settles with Unified

On November 9, 2022, the Board issued an order terminating IPR2022-01026 pursuant to a joint settlement request filed by Unified Patents and Savannah Licensing, an NPE and IP Edge entity. U.S. Patent 9,454,777 relates to using feedback based on a user's indication of frustration with a device and had been asserted against Nuu Mobile, Atlassian, Snapchat, Instagram, Sony, and others.

Dolby European AV1 patent related to Interdigital family revoked

On November 7, 2022, the European Patent Office revoked all claims of EP 3678097 owned by Dolby International AB. EP’097 is related to patents that have been declared essential to HEVCA and to SISVEL’s AV1 pool. InterDigital VC Holdings has designated its parent, EP 1627359, as essential to the AV1 standard. The EP’097 patent relates to a method for simulating the film grain that would result from the physical process of exposure and development of film in digital video. This filing was a part of Unified’s ongoing efforts in its SEP Video Codec Zone.

AlterWAN final decision affirmed by Federal Circuit

On November 14, 2022, the Federal Circuit affirmed the Patent Office's final decision, in a summary Rule 36 affirmance, confirmed that AlterWAN, Inc.’s U.S. Patent 9,667,534 was unpatentable. The ‘534 patent, directed to routing packets via VPN, had been asserted in district court litigation against Amazon Web Services.

Magnetar Capital entity, Speir Technologies, wireless device patent likely invalid

On November 9, 2022, the Patent Trial and Appeal Board (PTAB) instituted trial on all challenged claims in an IPR filed by Unified against U.S. Patent 7,321,777, owned and asserted by Speir Technologies Ltd., an NPE and Magnetar Capital entity. The ’777 patent relates to using a wireless device to locate a remote wireless device and has been asserted against Samsung and Apple.

Two ETRI Chinese Video Codec patents held invalid

The China National Intellectual Property Administration (CNIPA) declared all claims of two patents owned by Electronics and Telecommunications Research Institute (ETRI) invalid. The two patents, CN108124162B and CN108174219, are related to patents designated as essential in HEVC Advance Patent Pool and in SISVEL's AV1 and VP9 pools.
