PATROLL Success: Defeating Low Quality Patents

In 2020, Unified Patents launched several strategic relationships with prior art vendors to increase the quality of the submissions for PATROLL. These vendors, Apex Standards, Techson IP, Amplified, Traindex, InQuartik, IPscreener, and now Google, have led to not only more submissions but high-quality prior art being announced against NPEs on a monthly basis. 

In 2018, there were 337 total submissions for various PATROLL contests. In 2019, that number dropped to 282. However, in 2020 that number climbed back up by nearly 40% to 389 submissions.

The increase in submissions allowed for more winners to be identified. While 2018 and 2019 saw only 11 and 18 announcements, 2020 had 24. This was a 50% increase from 2019. With 20 active contests and a new prior art tool that Unified has launched, that number is expected to be even higher.

Interestingly, the addition of using the various vendors led to 282 unique submissions last year. This would account for nearly 73% of all submissions last year. Of these 282 submissions, 40 were identified as winning submissions. It should be noted that many times, multiple submissions are used for a contest winner. 

Of these 40 submissions, nearly half of them came from one or several of the prior art reports provided by the various vendors. By establishing these relationships with the vendors, it aided our searchers in finding high-quality art to defeat low-quality patents. PATROLL is just one of many tools that Unified provides in helping to improve patent quality. 

$3,000 for Texas Secure Authentication Prior Art

On December 15, 2020, Unified Patents added a new PATROLL contest, with a $3,000 cash prize, seeking prior art on at least Claim 1, 6, and 7 of U.S. Patent 7,873,682. This patent is owed by Texas Secure Authentication, LLC, an NPE. The '682 patent generally relates to determining identification information through a plurality of container registers using multi-factor authentication methods in online banking and internet services. It is being asserted against FCT Bancshares, Inc. and its subsidiary, First National Bank of Central Texas, in the Western District of Texas. The complaint acknowledges that the '682 patent expired on February 25, 2019.

$3,500 for Trust & Verify Data Protection Prior Art

Unified Patents has a PATROLL contest, with a $3,500 cash prize, seeking prior art on all of the limitations of dependent Claim 10, and including all of the limitations of independent Claim 4, of U.S. Patent 7,162,735. The patent is owned by Trust & Verify Data Protection, LLC, an NPE. The '735 patent generally relates to an arrangement with a protected code that comprises incomplete executable code and a call instruction to a security code such that when the security code is executed, it replaces the call instruction such that the executable code of the protected code is complete.

The ‘735 patent is currently being asserted against Best Buy, McAfee, and Buzzfeed.

On October 30, 2020, Unified Patents added a new PATROLL contest, with a $3,500 cash prize, seeking prior art on at least Claim 1 of U.S. Patent 10,104,198. This patent is owned by PerDiemCo LLC, an NPE. The '198 patent generally relates to tracking information of a plurality of users and giving users different administrative privileges for maintaining information sharing and describing event condition. The '198 patent has been asserted against CalAmp Corp. and GPS Insight.

This patent is owned by Hawk Technology Systems, LLC, an NPE that focuses its assertions against various school districts (e.g., DeSoto County School District, 3:18-cv-00132 ND Miss.) and charitable organizations, such as Goodwill (3:16-cv-00279 SD Miss.), for simply using a security camera.
