Mimzi Stay Based in Part on Unified’s Reexam Granted in EDTX

On March 27, 2026, Magistrate Judge Roy Payne has granted the motion to stay the Eastern District of Texas litigation against Ford, Subaru, and Mercedes-Benz AG pending resolution of Unified’s ex parte reexamination challenging U.S. Patent 9,792,361 and the Mercedes reexaminations challenging U.S. Patent 9,792,361 and U.S. Patent 11,100,163. In addition, the cases against Honda, Hyundai, and Nissan have been voluntarily dismissed.

In October 2025, Unified filed an ex parte reexamination proceeding against the '361 patent, owned and asserted by Mimzi, LLC, an NPE. The ’361 patent relates to using a phone to record phone calls, meetings, and dictation, and to store associated metadata, audio, and/or speech-recognized text in a centralized, content-searchable repository. Unified is represented by in-house counsel, Kyla Butler and Alyssa Holtslander.

Unified’s Gatekeeper reexam results in litigation stay

In Gatekeeper Solutions, Inc. v. Darktrace, Inc. (4:2024-cv-00723), the court has ordered that all proceedings are stayed pending the PTO’s final decision in Unified Patents’ ex parte reexamination of U.S. Patent 9,032,038. The Central Reexamination Unit (CRU) granted Unified’s reexamination request, finding substantial new questions of patentability on challenged claims 1-6, 10-28, and 32-45 of the ‘038 patent, owned and asserted by Gatekeeper Solutions, Inc., an NPE and entity of AiPi Solutions. On March 17, 2025, the examiner issued a non-final Office Action against the challenged claims.

The ‘038 patent relates to systems and methods for alerting a user of conflicting recipients when sending electronic communications. It has been asserted several times, but most recently against Darktrace, Forcepoint, and Trellix.
